What Does Disclaimer Mean?

A statement, traditionally at the top of a fic, declaring the author does not own the characters and makes no profit. Largely a ritual of older fandom; modern archives have made it mostly obsolete.

Disclaimer in Practice

Disclaimers were armor from fanfiction's legally nervous decades: writers on FanFiction.Net and mailing lists prefaced everything with 'I don't own them, please don't sue,' often in elaborately jokey variations that became a tiny literary form of their own. The legal value was always dubious, and the modern fan-lawyering consensus — embodied by the Organization for Transformative Works — rests fanfiction's legitimacy on transformative fair use rather than disclaimers. AO3's site-wide terms cover the territory, so per-fic disclaimers faded; encountering one now is a charming carbon-dating tell, like a fic listing its file size. The instinct survives in author's notes crediting inspirations and borrowed concepts.
