'Transformative' is the load-bearing word in fandom's legitimacy case: in U.S. copyright doctrine, works that add new expression and meaning to source material — commentary, recontextualization, new purpose — weigh toward fair use, and fandom organized its self-understanding around that principle. The Organization for Transformative Works, AO3's parent nonprofit, put the term in its name deliberately, asserting that fanworks are creative works in their own right rather than derivative infringement or mere copying. The framing also does cultural work inside fandom, positioning fic and vids within a long human tradition of retelling and reinterpretation. The legal questions are genuinely unsettled in places, but the term gave fandom both a flag and an argument — which is why a phrase from copyright analysis became everyday community vocabulary.
